Post Subject: Bankruptcy - Cox will not cancel contract

Hi,

I have tried phone, chat, and email and still have not received resolution to our issues.  So I will try here.

We filed for bankruptcy, chapter 7, back on August 19th.  We requested in the petition that the contract be cancelled, legally referred to as rejecting the contract.  Cox will not cancel our services without applying the EFT, which is, of course, illegal. At least on a civil basis. Not sure of the criminal ramifications, although I do know laws protecting the consumer filing a chapter 7 case are strict and spelled out quite prescisely.

My lawyer has called and actually received a fax number, along with instructions, for us to proceed.  Unfortunately, I have faxed on three separate days without any response or action taken by Cox.  I requested quite simply that our TV and Phone service be discontinued and our Internet remain as is, and that we would continue to receive internet from Cox.  No response.  Then I emailed again and got the same canned response, that an EFT would be charged.  This is getting extremely frustrating.  We also are requesting that our bill be credited for the amounts pre-billed thru Oct 20th, relating to tv and phone, from the original date of request.  Quite simple.  But no response.

This is a legal matter, Cox, not something you can sweep under the rug.

Better training is needed, I am afraid.  I find it hard to believe there is not a department that handles legal issues such as bankruptcies, and that your aassociates are not trained to forward these types of issues immediately, rather than stating you will bill for something that is no longer enforceable.

Please contact me, as we will not be paying our bill as long as it is in dispute.  We want to continue with Internet so it is in your best interest.

Thanks,

Brian
